HG 203/1994

The deeds that constitute minor offences against the norms regarding transport on the Romanian Railways, the sanctions to be enforced and the bodies that are entitled to find out and sanction such deeds are those established under H.G. (Government Decision) 203/1994 updated by H.G. 1274/1996. The following deeds shall constitute minor offences against the norms regarding transport on the Romanian Railways, if not committed under such circumstances as to be considered, under the penal law, as offences and shall be sanctioned as follows:

Government Decision no 203/1994 – regarding the establishment and sanction of minor offences against the norms regarding transport on the Romanian Railways (excerpts)
„Art. 2. – The following deeds shall be considered as minor offences against the norms regarding transport on the Romanian Railways, if not committed under such circumstances as to be considered, under the penal law, as offences :
1. entry on the station platforms, as established by S.N.C.F.R. without a traveling ticket or a platform voucher;
2. refusal to make free the occupied seat that does not correspond to that stated in the ticket as well as the refusal to give up to other passengers the seat that was occupied in excess, in an abusive way or in the compartment that is reserved for mothers and children, when he/she is not entitled to the said seat;
3. travel with a ticket without speed supplement, seat reservation voucher, couchette, bed or cabin supplement, at a higher class than that stated in the held ticket or on a detour route as well as any continuation of the interrupted trip with his/her ticket being not provided with any visa, in case such visa is mandatory, if the appropriate rates are not paid on the spot;
4. selling a ticket at a profit;
5. selling of tickets in other places than those established by S.N.C.F.R. or through unauthorized persons;
6. travel based on a free ticket, subscription or a reduced-price ticket, without presenting the identity document or another document in proof of such right;
7. travel without a ticket and refusal to pay the relevant fares by passengers, travel with a ticket that is not endorsed on departure in such cases when the visa is mandatory or based a ticket whose validity has expired or that has been issued for a destination station that was outrun or that belongs to another person, in case of nominal tickets or those whose data have been modified as well as the continuation of an interrupted trip, when using tickets that do not give any right to interruptions, if the appropriate rates are not paid on the spot. The disciplinary measures pursuant to art. 44 of Law no 32/1968 shall be enforced on the military on duty and those being assimilated to them;
9. smoking in waiting rooms and the mother and children’s room in the stations, the compartments, restaurant cars as well as in other places where smoking is forbidden as advised on posters or appropriate signs;
10. transport in passenger cars of live poultry/birds or stock, luggage that exceed the volume and weight limitations as established by S.N.C.F.R. or that do not observe the conditions set in the respective rate or other legal dispositions, in the absence of a luggage car or if he/she refuses their handing over to such car against the payment of appropriate rates;
11. exercise of trade on trains or in stations without any permit to be issued by the railway bodies or other competent bodies;
12. sticking of posters on trains or in stations, without the written agreement of the railway units;
16. opening of exterior door of the cars during the train running, blocking of exterior and frontal doors of the cars during train stationing, use of car toilets during the train stop and stationing;
17. begging for the passengers’ mercy or playing games of chance on trains or the railway units;
18. breaking of windows in cars, hauling vehicles or buildings located on the property of railways;
19. disturbance without any right of the passengers’ quietness by making noises with any device or object or by shouting, uproar or in other ways;
20. disrespectful behaviour and inadequate conduct as to the other passengers and the railway staff during the exercise of their function or any encumbrance on the exercise of their duties;
21. making scandal in transport vehicles or in the railway unit premises;
22. refusal of passengers – customers to leave the restaurant car or the bar after the closing hour or further to the justified request of any employee serving in the respective car;
24. travelling on stairs, buffers or roof of the cars within the passenger trains, getting on or off the cars in other places than the allowed ones;
27. driving the emergency signal and the hand brake of the cars for reasons that are not justified by an imminent danger for the train or passengers safety;
28. driving of the elements of the brake system that are mounted outside the cars, their insulation or operation by unauthorized persons;
29. driving by unauthorized persons of the unloading systems of specialized goods wagons as well as driving of installations that are used for lighting and heating of transport vehicles or in other places, that accommodate the passengers;
30. throwing of objects of any kind off the car window or door;
31. throwing onto the passengers or the railway vehicles of stones or other objects, inflammable, irritant or paralyzing, corrosive or dirt producing substances;
34. unauthorized writing or drawing, on the walls of buildings or cars, any dirt application on buildings, cars, installations, premises inside the stations and in the area of the railway lines, sticking off or destruction, without any right, of advertisements, announcements and posters;
39. transport in passenger cars of luggage and parcels with inflammable, explosive, radioactive, stinking or poisonous objects or substances or other hazardous matters and objects which are not allowed, as stated by law, for transport;

Art. 3. – The minor offences provided under art. 2 shall be sanctioned as follows:
a) with a fine from 100 lei to 250 lei, those stated under item 1 and 3;
b) with a fine from 100 lei to 300 lei, those stated under item 9 and 12;
c) with a fine from 250 lei to 400 lei, those stated under items 2, 6, 7, 8, 10, 16, 19, 23, 24 and 34;
d) with a fine from 300 lei to 600 lei, those stated under item 38;
e) with a fine from 350 lei to 800 lei, those stated under item 17, 20, 21, 22, 29;
f) with a fine from 500 lei to 750 lei, those stated under items 4, 5, 11, 18, 27, 28, 30, 31;
g) with a fine from 400 lei to 500 lei, those stated under item 39;
h) with a fine from 600 lei to 900 lei, those stated under item 52 and 53
